Copyright 2012 Pennsauken SchoolsSUMMARY OF THE SCHOOL ELECTION LAW ALLOWINGTHE SCHOOL BOARD ELECTION TO BE MOVED TO NOVEMBERThe new law provides different procedures for the moving of the school election to November.Procedures to change election date:1. By adoption of a resolution by the Board of Education2. By adoption of a resolution by the governing body of the municipality3. A ballot question presented to the voters in a November election. Procedurally, a petition Would need to be signed by not less than fifteen (15) percent of the voters who voted in the district during the last preceding presidential election.If the school board election is moved to November:Board of Education Members: 1. School Board Members would be elected in November and take office in January.2. Sitting School Board Members would have their terms extended until JanuaryDistrict's Budget:1. The a vote on the district's budget would not be required if the proposed tax levy is at or below The two (2) percent levy cap. Any request for spending above the cap would be presented to the voters for approval in November.2. The district budget still must be submitted to the commissioner for approval.3. If the district prepared a budget in excess of the two (2) percent cap, the district would send a temporary budget at or below the two (2) percent cap to the commissioner and the amount above the cap would be submitted to the voters in November for approval.A.)If the voters approve the additional amount above the cap, the board of educationWould submit the resulting final voter approved budget to the commissioner. The tax levy would then be recertified to reflect the additional amount.B.)If the voters reject the additional amount above the cap, the district's temporary Budget would become the district's final budget for the school year.Duration:1.If the district approves moving the election to November, then the district would be precluded from the changing the election back to April for at least four (4) years.
